
A cancellation policy for mediation is required for two reasons:
- More than one case is seeking to schedule mediation on the same date.
Because of previously scheduled mediation, these parties are unable to schedule these dates. They are then inconvenienced to schedule for a later
date or choose another provider of mediation.
- Because our office is committed to providing only mediation and arbitration services, if a
mediation is untimely cancelled, there is no legal practice with which
to substitute the lost revenue.
Therefore, the cancellation policy is as follows:
- If the mediation is cancelled on or within 5 business days of the date
scheduled, then one-half of the full minimum charge for that designated
mediation period is subject to being charged to the canceling
party. A full day cancellation charge is $1,800.00 and a one-half day
cancellation charge is $900.00.
- The mediator's staff will use their very best efforts to reschedule
another mediation in the cancelled mediation time period. The cancellation
fee will be reduced in direct proportion to the extent of successful
rescheduling. If prepayment has occurred, no cancellation fee will be
taken from the prepayment, without permission.
- The cancellation fee/charge applies to any cancellation for any reason,
including but not limited to: settlement, need for additional discovery,
vacations, business conflicts, and foreseeable court hearings. Sudden
medical emergencies, unforeseeable court hearings, and being called to trial
in another case may be acceptable excuse
for a no cancellation fee/charge. The mediator will determine acceptable
causes.
- All of these problems may be avoided if mediations are scheduled seriously and carefully. If something should arise that will hinder the progress of the scheduled mediation, please advise the mediation staff prior to five business days before the scheduled mediation.
